Terms of Service — Leasing Headquarters

These Terms of Service ("Terms") govern your access to and use of Leasing Headquarters (the "Service"), operated by The Wireless Advisors LLC D/B/A LeasingHQ, 5900 Balcones Drive #32899, Austin, TX 78731 ("we", "us", "our"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Leasing Headquarters is a web-based applicant tracking and leasing workflow tool for apartment communities. Features include per-property applicant checklists, welcome letter templates, concession and gift card tracking, and white-label branding.

2. Eligibility & Accounts

You must be at least 18 years old and, if signing up on behalf of an organization, have authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it updated.

3. Acceptable Use

You agree not to misuse the Service. You will not:

use the Service for any unlawful purpose or in violation of any applicable law;
engage in fraud, spam, or misrepresentation;
infringe the intellectual property or privacy rights of others;
upload malware, probe, scan, or attempt to breach security or authentication;
scrape, reverse engineer, or attempt to derive source code;
resell, sublicense, or redistribute the Service without our written consent.

Your use of the Service is also subject to our Acceptable Use Policy.

4. Customer Data

You retain ownership of the applicant, property, and operational data you submit ("Customer Data"). You grant us a limited, non-exclusive license to host, process, and display Customer Data solely to provide, secure, support, and improve the Service. You are responsible for having a lawful basis to submit personal information about applicants and residents, for providing them any required notices, and for the accuracy of the data.

We process personal information within Customer Data as your processor under our Data Processing Addendum, which is incorporated into these Terms. We may use aggregated, de-identified data that identifies no customer, property, or individual to improve the Service.

The Service is not designed to hold Social Security numbers, government ID images, full financial account numbers, or health information. Please do not upload them.

4A. Integrations with Property Management and Verification Platforms

You may connect third-party systems such as RealPage OneSite, Yardi, or Verifast. By enabling an integration you authorize us to access, retrieve, and transmit the relevant data using the credentials or authorizations you provide, and you confirm you are entitled to grant that access. We access only the fields the integration requires and store credentials encrypted.

We are not responsible for the availability, accuracy, security, or terms of any connected platform. Screening, income, identity, and fraud-verification results come from those providers. We are not a consumer reporting agency, we do not make or recommend leasing decisions, and you remain solely responsible for fair housing, screening, and adverse action compliance. You can revoke an integration at any time; that stops future syncing but does not remove data already in the Service.

4B. Security

We maintain administrative, physical, and technical safeguards described in our Security Overview, including encryption in transit and at rest, role-based access, per-property row-level isolation, and audit logging. We will notify affected account administrators without undue delay, and within seventy-two (72) hours of confirmation, of a security incident affecting Customer Data.

5. Intellectual Property

The Service, including software, design, and branding, is owned by The Wireless Advisors LLC D/B/A LeasingHQ and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have subscribed to. All rights not expressly granted are reserved.

6. Payments & Subscriptions

Paid subscriptions are billed monthly or annually per property, as selected at checkout. The Wireless Advisors LLC D/B/A LeasingHQ is the seller of record for all subscriptions. Payments are processed securely by Stripe; by purchasing, you also agree to Stripe's terms. Subscriptions renew automatically until cancelled. Applicable taxes are calculated and collected at checkout. We may also issue invoices directly; invoiced amounts are due by the date stated on the invoice.

7. Service Availability

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or changes that temporarily affect availability.

8. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may cancel your subscription at any time. On termination, your right to use the Service ends; we will make Customer Data available for export for a reasonable period, after which it may be deleted.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

The Service is a workflow tool, not legal, fair housing, tax, or compliance advice. Figures the Service calculates — including prorated rent, move-in balances, concessions, and total due — are estimates based on the data you enter and must be reviewed by you before being shared with an applicant or resident.

10. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the fees you paid us in the twelve (12) months preceding the claim. We will not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, gross negligence, or where limitation is prohibited by law.

11. Indemnification

You will indemnify and hold harmless The Wireless Advisors LLC D/B/A LeasingHQ from any third-party claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Exclusive venue for disputes lies in the state or federal courts located in Travis County, Texas.

12A. Enterprise Agreements

Multi-property and invoiced customers may contract under our Master SaaS Subscription Agreement. Where a signed order form or that agreement applies, it controls over these Terms to the extent of any conflict.

13. Changes

We may update these Terms from time to time. If changes are material, we will provide notice via the Service or email. Continued use of the Service after changes take effect constitutes acceptance.
