Terms of Service

These Terms of Service ("Terms") govern your access to and use of Leasing Command Center (the "Service"), operated by The Wireless Advisors LLC, 1710 Keller Parkway #5553, Keller, TX 76248 ("we", "us", "our"). By creating an account, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Leasing Command Center is a web-based applicant tracking and leasing workflow tool for apartment communities. Features include per-property applicant checklists, welcome letter templates, concession and gift card tracking, and white-label branding.

2. Eligibility & Accounts

You must be at least 18 years old and, if signing up on behalf of an organization, have authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it updated.

3. Acceptable Use

You agree not to misuse the Service. You will not:

• use the Service for any unlawful purpose or in violation of any applicable law;
• engage in fraud, spam, or misrepresentation;
• infringe the intellectual property or privacy rights of others;
• upload malware, probe, scan, or attempt to breach security or authentication;
• scrape, reverse engineer, or attempt to derive source code;
• resell, sublicense, or redistribute the Service without our written consent.

4. Customer Data

You retain ownership of the applicant, property, and operational data you submit ("Customer Data"). You grant us a limited, non-exclusive license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for having a lawful basis to submit personal information about applicants and residents.

5. Intellectual Property

The Service, including software, design, and branding, is owned by The Wireless Advisors LLC and its licensors. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have subscribed to. All rights not expressly granted are reserved.

6. Payments & Subscriptions

Paid subscriptions are billed monthly or annually per property, as selected at checkout. The Wireless Advisors LLC is the seller of record for all subscriptions. Payments are processed securely by Stripe; by purchasing, you also agree to Stripe's terms. Subscriptions renew automatically until cancelled. Applicable taxes are calculated and collected at checkout. We may also issue invoices directly; invoiced amounts are due by the date stated on the invoice.

7. Service Availability

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform maintenance, updates, or changes that temporarily affect availability.

8. Suspension & Termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated policy violations. You may cancel your subscription at any time. On termination, your right to use the Service ends; we will make Customer Data available for export for a reasonable period, after which it may be deleted.

9. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service will not exceed the fees you paid us in the twelve (12) months preceding the claim. We will not be liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, gross negligence, or where limitation is prohibited by law.

11. Indemnification

You will indemnify and hold harmless The Wireless Advisors LLC from any third-party claims arising out of your Customer Data, your use of the Service, or your breach of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles. Exclusive venue for disputes lies in the state or federal courts located in Tarrant County, Texas.

13. Changes

We may update these Terms from time to time. If changes are material, we will provide notice via the Service or email. Continued use of the Service after changes take effect constitutes acceptance.
